Phenomenal Escapes

Please read these Terms & Conditions carefully before making a reservation with Phenomenal Escapes. By submitting a deposit or payment for a trip, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
Phenomenal Escapes curates group travel experiences in partnership with independent hotels, cruise lines, airlines, transportation providers, tour operators, excursion providers, restaurants, and other travel suppliers. The terms below explain your responsibilities as a traveler, our responsibilities as your travel organizer, and the policies that apply to reservations made with Phenomenal Escapes.
1. BOOKING & RESERVATIONS
Phenomenal Escapes curates group travel experiences in partnership with independent travel suppliers. All reservations are subject to availability and are not considered confirmed until the required deposit or payment has been received.
Travelers are responsible for providing complete and accurate information at the time of booking. The name submitted for each traveler must match the government-issued identification or passport that will be used for travel. Any costs associated with correcting or changing traveler information after a reservation has been made are the responsibility of the traveler.
Reservation requirements, including deposit amounts, payment schedules, final payment dates, and package inclusions, may vary by trip. The specific terms provided on the booking page for each Phenomenal Escapes experience are incorporated into these Terms & Conditions.
By submitting a reservation and making a deposit or payment, the traveler acknowledges and agrees to these Terms & Conditions and any trip-specific terms presented at the time of booking.
2. PAYMENTS, DEPOSITS & PAYMENT PLANS
Deposits
A deposit is required to secure a reservation unless otherwise stated on the applicable trip booking page. Deposits are non-refundable unless the trip-specific terms expressly state otherwise. Deposit amounts vary by experience and will be disclosed before booking.
Payment Plans
When a payment plan is offered, travelers are required to make payments according to the payment schedule established for their reservation. Payment schedules, installment amounts, and final payment deadlines may vary by trip and will be provided at the time of booking.
A final payment deadline does not permit a traveler to postpone scheduled installment payments until the end of the payment period. Accounts must remain current throughout the payment plan.
Late or Missed Payments
If a scheduled payment is not received by its due date, the traveler will have seven (7) calendar days to bring the account current. Phenomenal Escapes reserves the right to cancel a reservation that remains past due after the grace period.
Phenomenal Escapes is not required to reinstate a reservation after cancellation for nonpayment. If reinstatement is permitted, it will be subject to availability, current supplier pricing, and any additional costs or fees resulting from the reinstatement.
Final Payment
Reservations must be paid in full by the final payment deadline stated for the applicable trip. Failure to pay the remaining balance by the final payment deadline may result in cancellation of the reservation.
Payments Already Made
Payments made toward a reservation are not held by Phenomenal Escapes as a savings account or refundable balance. Payments may be used or committed to secure accommodations, transportation, activities, group arrangements, and other travel services.
If a reservation is canceled by the traveler or canceled due to nonpayment, any refund eligibility will be determined according to the cancellation terms applicable to that specific trip, including amounts already committed to or retained by travel suppliers.
Personal circumstances, including but not limited to financial hardship, employment changes, illness, family emergencies, relationship changes, or scheduling conflicts, do not automatically entitle a traveler to a refund outside of the applicable cancellation terms.
Payment Processing
Travelers are responsible for any payment-processing, transaction, or other fees disclosed during the booking or payment process. All payments must be made through the payment methods authorized by Phenomenal Escapes.
3. CANCELLATIONS, REFUNDS & RESERVATION CHANGES
Traveler Cancellations
All cancellation requests must be submitted in writing to info@phenomenalescapes.com. A reservation is not considered canceled until Phenomenal Escapes has received the written cancellation request.
Cancellation policies vary by trip because hotels, cruise lines, transportation providers, tour operators, and other suppliers establish their own payment and cancellation requirements. The cancellation schedule provided on the applicable trip booking page is incorporated into these Terms & Conditions and will determine the traveler's eligibility, if any, for a refund.
Unless otherwise stated in the trip-specific terms, deposits are non-refundable.
Refunds
Phenomenal Escapes does not guarantee that payments made toward a trip will be refundable. Once payments are received, funds may be paid or committed to travel suppliers or used to secure group arrangements and services.
When a traveler cancels, any refund for which the traveler is eligible will be calculated according to the trip-specific cancellation schedule and may be reduced by non-refundable deposits, supplier penalties, services already purchased or committed on the traveler's behalf, and other nonrecoverable costs.
Phenomenal Escapes will not be required to refund amounts that a supplier does not return or credit to Phenomenal Escapes, except where otherwise required by applicable law or expressly stated in the trip-specific terms.
Personal Circumstances
We understand that unexpected circumstances sometimes prevent travelers from taking a planned trip. However, personal circumstances—including illness, injury, family emergencies, employment or financial changes, relationship changes, scheduling conflicts, or a change of mind—do not automatically override the cancellation policy applicable to the reservation.
Travelers are strongly encouraged to purchase appropriate travel insurance to help protect their financial investment against eligible unforeseen circumstances.
Reservation Changes & Transfers
Requests to change a reservation, including traveler information, occupancy, accommodations, optional services, or other booking details, are subject to availability and the policies of the applicable travel suppliers.
Any supplier-imposed fees, fare increases, penalties, or additional costs resulting from a requested change are the responsibility of the traveler.
Reservations may not be transferred or substituted to another traveler unless expressly approved by Phenomenal Escapes and permitted by the applicable suppliers. Approval is not guaranteed.
Unused Services
No refund or credit will be provided for accommodations, transportation, activities, meals, excursions, or other trip components voluntarily missed or unused by a traveler after travel has begun, except where otherwise required by the applicable supplier or law.
4. TRAVEL INSURANCE
Travel Insurance Recommendation
Phenomenal Escapes strongly recommends that all travelers purchase comprehensive travel insurance to help protect their financial investment and themselves against eligible unforeseen circumstances.
Depending on the policy selected, travel insurance may provide benefits for covered circumstances involving trip cancellation or interruption, medical emergencies, emergency evacuation, baggage loss or delay, travel delays, and other travel-related events.
Traveler Responsibility
Travelers are responsible for reviewing, selecting, and purchasing travel insurance appropriate for their individual needs and circumstances. Insurance policies vary significantly in their benefits, exclusions, coverage limits, eligibility requirements, and deadlines for purchase.
Phenomenal Escapes does not determine whether a traveler's circumstances qualify for insurance coverage and does not guarantee that any claim submitted to an insurance provider will be approved.
Unless otherwise expressly stated, the purchase of travel insurance does not alter the cancellation and refund terms applicable to a Phenomenal Escapes reservation.
Declining Travel Insurance
A traveler who chooses not to purchase travel insurance accepts the financial risks associated with that decision, including the possibility of losing some or all payments made toward a trip if the traveler is unable to travel.
5. TRAVELER NAMES, PASSPORTS, VISAS & ENTRY REQUIREMENTS
Traveler Names & Identification
Travelers are responsible for providing their complete legal name exactly as it appears on the government-issued identification or passport that will be used for travel.
It is the traveler's responsibility to review all reservation information and promptly notify Phenomenal Escapes of any errors. Name corrections or changes after a reservation has been made may be subject to supplier restrictions, cancellation and rebooking requirements, fare increases, or additional fees. All costs resulting from traveler-provided errors or requested name changes are the responsibility of the traveler.
Passports, Visas & Entry Requirements
Each traveler is responsible for obtaining and maintaining all documentation required for their trip, including passports, visas, permits, identification, vaccination or health documentation, and any other documents required by the destination, transportation provider, or applicable governmental authority.
Passport validity, blank-page requirements, visa requirements, and other entry or transit requirements vary by destination and may change at any time. Travelers are responsible for verifying the requirements applicable to their citizenship, residency status, itinerary, and travel dates.
Information provided by Phenomenal Escapes regarding travel documentation or entry requirements is provided as a convenience and does not replace the traveler's responsibility to verify current requirements with the appropriate government authorities.
Denied Boarding or Entry
Phenomenal Escapes is not responsible for a traveler being denied boarding, entry, transit, or participation in a trip because of missing, expired, incorrect, or insufficient travel documentation or failure to comply with applicable entry requirements.
Any resulting expenses, penalties, missed services, transportation costs, or other losses are the responsibility of the traveler. Refunds for unused trip components will be subject to the applicable supplier and trip-specific cancellation terms.
6. PRICING & SUPPLIER CHANGES
Pricing
Trip prices, deposits, payment schedules, and package inclusions will be disclosed on the applicable Phenomenal Escapes booking page or proposal. Unless otherwise stated, prices are quoted per person and are based on the occupancy, accommodations, transportation, activities, and other services specified for that particular trip.
Prices are based on supplier rates and information available at the time the trip is created and may be subject to availability until a reservation or applicable service has been confirmed.
Travelers are responsible for expenses not specifically listed as included in their trip package, including personal purchases and any optional services or activities they choose to purchase.
Supplier-Imposed Changes
Hotels, airlines, cruise lines, transportation providers, tour operators, and other independent suppliers may change their prices, taxes, fees, fuel surcharges, schedules, policies, services, or availability.
If a supplier imposes a material price increase or change after booking that affects a traveler's reservation, Phenomenal Escapes will notify affected travelers and provide available options based on the supplier's applicable terms and the circumstances of the change.
Phenomenal Escapes will not impose additional charges on a confirmed reservation solely because the advertised price of the trip later increases for new bookings. However, travelers remain responsible for additional costs resulting from traveler-requested changes, government-imposed taxes or fees, supplier-imposed charges permitted under the applicable reservation terms, or circumstances otherwise disclosed in the trip-specific terms.
Errors & Corrections
Phenomenal Escapes reserves the right to correct typographical, calculation, website, or other inadvertent errors in pricing or trip information.
If a material pricing error is discovered after a reservation has been made, Phenomenal Escapes will notify the affected traveler and provide the available options, which may include accepting the corrected price or canceling the affected reservation and receiving a refund of amounts paid to Phenomenal Escapes for the affected services, subject to any applicable supplier terms and legal requirements.
7. AIRFARE & TRANSPORTATION
Airfare
Unless specifically listed as included in the applicable trip package, airfare is not included in the price of a Phenomenal Escapes experience.
When airfare is included or arranged through Phenomenal Escapes, airline tickets are subject to the applicable airline's terms, conditions, restrictions, baggage policies, change and cancellation rules. Once ticketed, airfare may be non-refundable and/or non-changeable depending upon the fare purchased.
Travelers who purchase their own airfare are responsible for ensuring that their flight arrangements are compatible with the applicable trip itinerary, including required arrival and departure times.
Airline & Transportation Changes
Airlines and other transportation providers control their own schedules, routes, equipment, seating, cancellations, delays, and operational decisions. These matters are outside the control of Phenomenal Escapes.
Phenomenal Escapes will make reasonable efforts to communicate material transportation changes of which we are notified. However, Phenomenal Escapes is not responsible for losses, additional expenses, missed services, or inconvenience resulting from delays, cancellations, schedule changes, missed connections, or other actions of an independent transportation provider, except to the extent otherwise required by applicable law.
Transfers & Group Transportation
Motorcoach transportation, airport transfers, private transportation, or other ground transportation is included only when specifically identified as part of the applicable trip package.
Travelers are responsible for arriving at designated departure or meeting locations by the stated time. A traveler who misses scheduled group transportation may be required to arrange and pay for alternate transportation to rejoin the group.
Phenomenal Escapes is not responsible for additional costs incurred because a traveler arrives late, misses scheduled transportation, changes independently arranged travel plans, or fails to provide updated transportation information when requested.
Seating & Special Requests
Seat assignments on airlines, motorcoaches, trains, cruise transfers, and other transportation are subject to the policies and availability of the applicable transportation provider unless a specific seating arrangement is expressly included in the Phenomenal Escapes package.
Phenomenal Escapes may submit seating or other special requests on a traveler's behalf but cannot guarantee that a supplier will honor those requests.
Baggage
Travelers are responsible for reviewing and complying with the baggage requirements of each applicable transportation provider, including size, weight, quantity, prohibited-item restrictions, and baggage fees.
Unless expressly included in the trip package, baggage fees, excess baggage charges, and other carrier-imposed baggage costs are the responsibility of the traveler.
Phenomenal Escapes is not responsible for baggage that is lost, delayed, stolen, or damaged while in the custody or control of an independent transportation provider. Travelers should report baggage problems directly to the responsible carrier and retain any documentation necessary for an insurance or carrier claim.
8. ACCOMMODATIONS, ROOMMATES & OCCUPANCY
Accommodations
Accommodations included in a Phenomenal Escapes trip will be described on the applicable booking page or trip itinerary. Hotel, resort, cruise cabin, and other accommodation assignments are subject to supplier availability and policies.
Phenomenal Escapes may request preferred room configurations, bedding arrangements, adjoining rooms, room locations, or other accommodation preferences on a traveler's behalf; however, unless expressly confirmed as part of the purchased package, special requests cannot be guaranteed.
Check-in and check-out times, room assignments, amenities, deposits, incidental charges, and other property policies are established by the applicable accommodation provider.
Occupancy
Trip pricing may vary based on occupancy. Travelers are responsible for selecting and paying for the appropriate occupancy level offered for their reservation.
If the number of occupants in a room changes after booking, the remaining traveler's price may change based on the new occupancy level and applicable supplier pricing. Any resulting increase, supplier fee, or other additional cost is the responsibility of the affected traveler.
A traveler will not automatically retain a double-, triple-, or other shared-occupancy price when another occupant cancels or is removed from the reservation.
Roommates
Travelers booking shared accommodations with a roommate are responsible for ensuring that all travelers assigned to the room complete their individual reservations, payments, and required documentation by the applicable deadlines.
If a traveler's selected roommate cancels, fails to make required payments, or otherwise becomes unable to travel, Phenomenal Escapes will make reasonable efforts to provide available options. However, Phenomenal Escapes does not guarantee that another roommate will be available.
The remaining traveler may be responsible for an increased occupancy rate, including a single-occupancy supplement, unless another eligible roommate is secured and approved.
Roommate Matching
When expressly offered for a particular trip, Phenomenal Escapes may provide a roommate-matching service as a convenience to travelers seeking shared accommodations.
Roommate matching is not a guarantee of compatibility. Phenomenal Escapes does not conduct background checks and makes no representation regarding a matched traveler's habits, personality, lifestyle, behavior, health, or compatibility.
Travelers participating in roommate matching accept the risks associated with sharing accommodations with another traveler. If a traveler later chooses not to room with the assigned roommate, any additional cost required to obtain alternate accommodations is the responsibility of the traveler requesting the change, subject to availability.
9. ITINERARIES, SCHEDULE CHANGES & MISSED SERVICES
Itineraries & Schedules
Phenomenal Escapes carefully plans each experience; however, published itineraries, schedules, activity times, venues, accommodations, transportation arrangements, and other trip components are subject to change.
Times provided in itineraries are approximate unless expressly identified as firm departure, boarding, or meeting times. Travelers are responsible for reviewing trip communications and following the most current itinerary and instructions provided by Phenomenal Escapes.
Itinerary Changes
Phenomenal Escapes reserves the right to modify the sequence, timing, location, supplier, accommodation, activity, or other component of an itinerary when reasonably necessary because of weather, closures, supplier availability, transportation changes, safety concerns, operational needs, government action, local conditions, or other circumstances affecting the trip.
When reasonably possible, Phenomenal Escapes will attempt to provide a comparable alternative for a materially changed included service. However, an exact replacement cannot be guaranteed.
A reasonable itinerary modification or substitution does not automatically entitle a traveler to cancel the trip or receive a refund. Any refund or credit resulting from a supplier cancellation or material change will be determined by the applicable supplier terms, trip-specific terms, and applicable law.
Traveler Punctuality
Travelers are responsible for arriving on time for all scheduled departures, meeting times, transportation, tours, activities, meals, and other trip components.
Group departures may proceed without a traveler who is late. Phenomenal Escapes is not required to delay the group or alter the itinerary to accommodate a late or absent traveler.
A traveler who misses a scheduled trip component is responsible for any transportation, admission, accommodation, or other costs necessary to rejoin the group or make alternate arrangements.
Missed or Unused Services
No refund or credit will be provided for trip components missed or voluntarily unused by a traveler, including because of late arrival, early departure, personal preference, independently arranged activities, or failure to follow the provided itinerary, except where otherwise required by applicable supplier terms or law.
10. ACCESSIBILITY, HEALTH & SPECIAL REQUESTS
Accessibility & Accommodation Requests
Phenomenal Escapes welcomes travelers with varying accessibility needs and will make reasonable efforts to assist travelers in identifying accommodations and services appropriate for their trip.
Travelers who require accessibility accommodations or have mobility, hearing, vision, or other needs that may affect participation are encouraged to notify Phenomenal Escapes as early as possible so that available options can be explored with the applicable travel suppliers.
Phenomenal Escapes cannot guarantee that every destination, property, transportation provider, excursion, activity, or other independent supplier will be able to provide every requested accommodation. Accessibility standards and available services may vary significantly by destination and supplier.
Personal Assistance
Phenomenal Escapes hosts, tour leaders, drivers, guides, and supplier personnel are not personal care attendants and generally cannot provide ongoing individual assistance with activities such as mobility, lifting, eating, dressing, medication administration, or other personal care.
Travelers who require personal assistance are responsible for arranging an appropriate travel companion or other assistance when necessary for their individual needs.
Health & Participation
Travelers are responsible for considering the physical and health requirements of an experience before booking and for determining whether they are able to participate safely.
Certain trips or activities may involve extended walking, stairs, uneven surfaces, heat, altitude, water activities, early departures, extended transportation periods, or other physical demands. When significant physical requirements are known, Phenomenal Escapes will make reasonable efforts to disclose them in the trip information.
Travelers should consult an appropriate healthcare professional regarding their individual ability to travel or participate when they have health concerns.
Dietary & Other Special Requests
Phenomenal Escapes will make reasonable efforts to communicate dietary restrictions, allergies, bedding preferences, accessibility requests, and other special requests to applicable suppliers when provided sufficiently in advance.
Special requests are subject to supplier availability and cannot be guaranteed unless expressly confirmed in writing.
Travelers with severe food allergies, medical dietary requirements, or other needs that could materially affect their health or safety remain responsible for evaluating whether the available arrangements are appropriate for them.
Health & Destination Requirements
Travelers are responsible for complying with health, vaccination, testing, documentation, or other requirements imposed by destinations, transportation providers, accommodations, cruise lines, tour operators, or governmental authorities.
Such requirements may change before or during travel. Phenomenal Escapes may provide available information as a convenience, but travelers remain responsible for verifying and satisfying the requirements applicable to their individual circumstances and itinerary.
11. TRAVELER CONDUCT & GROUP EXPERIENCE
Respectful Conduct
Phenomenal Escapes is committed to creating enjoyable, welcoming, and respectful group travel experiences. Travelers are expected to conduct themselves in a manner that respects fellow travelers, Phenomenal Escapes representatives, travel suppliers, local communities, and property.
Harassment, threats, violence, abusive or discriminatory behavior, intentional disruption of group activities, damage to property, illegal activity, or other conduct that materially interferes with the safety, well-being, or reasonable enjoyment of the group will not be tolerated.
Alcohol & Other Substances
Travelers are responsible for their own behavior and safety when consuming alcohol. Excessive intoxication, illegal drug use, or substance-related behavior that creates a safety concern, disrupts the group, damages property, or interferes with travel services may result in removal from an activity or trip.
Travelers are responsible for complying with all applicable laws and supplier policies regarding alcohol, medications, controlled substances, and other substances.
Supplier & Destination Rules
Travelers must comply with reasonable instructions, safety requirements, dress codes, conduct policies, and other rules established by hotels, cruise lines, transportation providers, venues, tour operators, restaurants, excursion providers, governmental authorities, and other applicable suppliers.
A traveler who is denied service, removed from a property or activity, or incurs penalties because of their own conduct is responsible for the resulting consequences and expenses.
Removal From an Experience
Phenomenal Escapes reserves the right, when reasonably necessary to protect the safety, well-being, or experience of the group, to remove a traveler from a group activity or discontinue that traveler's participation in a Phenomenal Escapes experience because of serious or repeated misconduct.
When circumstances reasonably permit, Phenomenal Escapes may first provide the traveler an opportunity to correct the behavior. Immediate action may be taken when conduct presents a safety concern, involves unlawful activity, harassment, threats, violence, serious disruption, or other circumstances requiring prompt intervention.
A traveler removed because of their conduct is responsible for any resulting transportation, accommodations, meals, penalties, or other expenses necessary to make alternate arrangements or return home. Refunds for unused trip components will be subject to the applicable trip-specific and supplier cancellation terms.
12. FORCE MAJEURE & EVENTS BEYOND OUR CONTROL
Events Beyond Our Control
Phenomenal Escapes is not responsible for delays, changes, cancellations, interruptions, or inability to provide travel services resulting from circumstances beyond its reasonable control.
Such circumstances may include, but are not limited to, severe weather, hurricanes, floods, earthquakes, fires, natural disasters, epidemics or pandemics, public health emergencies, acts or orders of government, border closures, war, civil unrest, terrorism or threats of terrorism, strikes or labor disputes, transportation disruptions, utility or infrastructure failures, supplier insolvency or operational disruption, or other events that make performance impossible, unsafe, illegal, or commercially impracticable.
Changes or Cancellations Resulting From a Force Majeure Event
If an event beyond the reasonable control of Phenomenal Escapes materially affects a trip, Phenomenal Escapes may modify, postpone, reschedule, substitute, or cancel affected portions of the experience when reasonably necessary.
Phenomenal Escapes will make reasonable efforts to communicate material changes and identify available options based on the circumstances and the policies of the affected travel suppliers.
Refunds, Credits & Supplier Funds
Refunds or travel credits resulting from an event beyond Phenomenal Escapes' control are subject to the terms and decisions of the applicable travel suppliers and the trip-specific cancellation terms.
Phenomenal Escapes cannot guarantee that a supplier will issue a cash refund rather than a future travel credit, permit a reservation to be transferred, or waive its normal cancellation penalties.
To the extent Phenomenal Escapes receives a refundable amount or transferable credit from a supplier specifically attributable to an affected traveler's reservation, Phenomenal Escapes will handle that amount or credit in accordance with the applicable supplier terms, trip-specific terms, and applicable law.
Phenomenal Escapes is not responsible for providing a refund from its own funds for amounts retained by or otherwise nonrecoverable from independent travel suppliers, except where otherwise required by applicable law.
Additional Traveler Expenses
Travelers are responsible for additional personal expenses resulting from circumstances beyond Phenomenal Escapes' control, including additional accommodations, meals, transportation, airfare changes, medical expenses, quarantine expenses, or other costs not included in the original trip package, unless an applicable supplier or travel insurance policy provides otherwise.
13. INDEPENDENT SUPPLIERS & LIMITATION OF RESPONSIBILITY
Independent Travel Suppliers
Phenomenal Escapes arranges and coordinates travel experiences using independent suppliers, which may include airlines, cruise lines, hotels, resorts, transportation companies, tour operators, excursion providers, restaurants, entertainment providers, local guides, and other third parties.
These suppliers are independent entities and are not employees, agents, or controlled entities of Phenomenal Escapes unless expressly stated otherwise.
Each supplier is responsible for the services, facilities, equipment, personnel, policies, and operations under its control.
Supplier Acts, Omissions & Changes
Phenomenal Escapes is not responsible for the acts, omissions, errors, delays, cancellations, service failures, schedule changes, overbooking, equipment failures, or other actions or decisions of independent travel suppliers that are outside Phenomenal Escapes' reasonable control.
When a supplier materially changes or fails to provide an included service, Phenomenal Escapes will make reasonable efforts to assist affected travelers and, when appropriate and reasonably available, identify alternatives. Any refund, replacement service, or credit will remain subject to the applicable supplier terms, trip-specific terms, and applicable law.
Third-Party Activities & Services
Travelers may have opportunities to participate in excursions, activities, dining, transportation, entertainment, or other services provided by third parties.
Participation in such services is subject to the terms, conditions, safety requirements, and policies of the applicable provider. Travelers are responsible for evaluating whether an activity or service is appropriate for their individual circumstances.
Activities or services independently purchased by a traveler and not included in the Phenomenal Escapes package are undertaken solely between the traveler and the applicable provider.
Matters Outside Phenomenal Escapes' Control
Phenomenal Escapes is not responsible for injury, loss, delay, inconvenience, additional expense, or disruption resulting from circumstances outside its reasonable control, including actions of independent suppliers, transportation disruptions, weather events, governmental actions, local conditions, criminal acts of third parties, illness, public health events, or other circumstances addressed elsewhere in these Terms & Conditions.
Nothing in these Terms & Conditions is intended to waive or limit any right or liability that cannot lawfully be waived or limited.
14. ASSUMPTION OF RISK & TRAVELER RESPONSIBILITY
Inherent Risks of Travel
Travel involves inherent risks that cannot be completely eliminated. Depending on the destination and activities involved, these risks may include illness or injury, severe or unexpected weather, transportation incidents, unfamiliar environments, uneven terrain, water or recreational activities, wildlife or insects, foodborne illness, crime, political or civil unrest, limited access to medical services, and other conditions associated with travel.
Travelers acknowledge that destinations may have different laws, customs, safety standards, infrastructure, medical resources, and emergency-response capabilities than those available in their home communities.
Voluntary Participation
By booking and participating in a Phenomenal Escapes experience, travelers acknowledge that they are voluntarily choosing to travel and participate in the activities included in their itinerary.
Travelers are responsible for reviewing available trip information, considering their individual circumstances and abilities, asking questions when additional information is needed, and making informed decisions regarding their participation.
Participation in optional activities is voluntary. A traveler who chooses not to participate in an included activity should notify Phenomenal Escapes when reasonably possible. Unless otherwise provided by the applicable supplier or trip-specific terms, voluntarily declining an included activity does not entitle the traveler to a refund for that activity.
Personal Safety & Decisions
Travelers remain responsible for exercising reasonable judgment regarding their personal safety and conduct throughout the trip.
This includes following reasonable safety instructions provided by Phenomenal Escapes representatives and travel suppliers, complying with applicable laws and destination requirements, safeguarding personal belongings and travel documents, and avoiding activities or circumstances the traveler believes exceed their individual abilities or comfort level.
Medical Emergencies
If a traveler becomes ill, injured, or otherwise requires medical assistance during a trip, Phenomenal Escapes may make reasonable efforts to assist the traveler in contacting local emergency services, medical providers, travel insurance providers, or other appropriate resources.
Phenomenal Escapes does not provide medical advice or medical care and cannot guarantee the availability, accessibility, quality, or outcome of medical services at a destination.
Unless otherwise covered by an applicable insurance policy or responsible third party, medical treatment, evacuation, additional accommodations, transportation, and other expenses resulting from a traveler's illness or injury are the responsibility of the traveler.
15. PHOTOGRAPHY, VIDEO & MEDIA
Photography & Recording During Trips
Phenomenal Escapes may photograph, record, or otherwise capture images and video during group trips, activities, events, and experiences. These images and recordings may include travelers participating individually or as part of the group.
Promotional Use
Unless a traveler opts out as described below, the traveler grants Phenomenal Escapes permission to use photographs and video captured during a Phenomenal Escapes experience for legitimate business and promotional purposes, including on our website, social media channels, email marketing, digital advertising, printed marketing materials, and other Phenomenal Escapes communications, without additional compensation.
Phenomenal Escapes will not knowingly use a traveler's name or personal story in a testimonial or endorsement without separate permission.
Opting Out
Travelers who do not wish to have their identifiable image used for Phenomenal Escapes promotional purposes should notify Phenomenal Escapes in writing at info@phenomenalescapes.com before the trip begins.
Phenomenal Escapes will make reasonable efforts to honor such requests in photographs and recordings under its control. Because group travel occurs in shared and public environments, Phenomenal Escapes cannot guarantee that a traveler will not incidentally appear in crowd, background, supplier, or other third-party photographs or recordings.
Traveler & Third-Party Content
Phenomenal Escapes is not responsible for photographs, video, social media posts, or other content independently created or shared by fellow travelers, travel suppliers, venues, members of the public, or other third parties.
16. DISPUTE RESOLUTION & GOVERNING LAW
Good-Faith Resolution
Phenomenal Escapes values its relationships with travelers and encourages the prompt resolution of concerns.
Before initiating formal legal proceedings regarding a dispute arising from a Phenomenal Escapes reservation or experience, the traveler agrees to provide Phenomenal Escapes written notice describing the dispute and the requested resolution. The parties agree to make a good-faith effort to resolve the matter informally before pursuing formal legal remedies.

Governing Law
These Terms & Conditions and disputes arising from or relating to a Phenomenal Escapes reservation or experience will be governed by applicable law, including the laws of the State of Texas where applicable, without limiting any consumer right or protection that cannot lawfully be waived.
Additional Dispute-Resolution Terms
Phenomenal Escapes may adopt additional legally permissible dispute-resolution procedures, including mediation or arbitration provisions, when disclosed and agreed to as part of a specific booking agreement or other written contract.
Nothing in this section is intended to waive any right or remedy that cannot lawfully be waived.
17. ACCEPTANCE OF TERMS
Agreement to Terms
By submitting a reservation, making a deposit or payment, or otherwise completing a booking with Phenomenal Escapes, the traveler acknowledges that they have had the opportunity to review these Terms & Conditions and agrees to be bound by them, together with any trip-specific terms, policies, disclosures, and supplier conditions applicable to the reservation.
Where an electronic acknowledgment, checkbox, signature, waiver, or other acceptance mechanism is presented during the booking process, travelers are required to complete that acknowledgment before their reservation may be finalized.
Trip-Specific Terms
Each Phenomenal Escapes experience may include additional terms specific to that trip, including deposit requirements, payment schedules, cancellation deadlines, refund eligibility, minimum participation requirements, occupancy requirements, age restrictions, transportation arrangements, and other conditions.
Those trip-specific terms are incorporated into and form part of the traveler's agreement with Phenomenal Escapes. If a trip-specific term conflicts with a general provision of these Terms & Conditions regarding that particular trip, the trip-specific term will control to the extent of that conflict.
Responsibility for Traveling Party
The person making a reservation is responsible for providing accurate information for the travelers included in the booking and for ensuring that each adult traveler receives access to the applicable trip information and Terms & Conditions.
Each adult traveler may be required to separately acknowledge applicable agreements, waivers, or disclosures before travel.
A parent or legal guardian booking travel for a minor is responsible for reviewing and accepting applicable terms on the minor's behalf and for providing any documentation or authorization required for the minor's travel.
Updates to These Terms
Phenomenal Escapes may update these Terms & Conditions from time to time. The version applicable to a reservation will generally be the version in effect when the reservation is made, except when a later change is required by law, governmental authority, supplier requirement, or is separately agreed to by the traveler.
